LIVEorDIE Terms of Service

Purpose
These Terms of Service (hereinafter "Terms") are established to define the rights, obligations, and responsibilities between RISELIX (hereinafter "the Company") and users, as well as the conditions and procedures for using the focus enhancement app LIVEorDIE (hereinafter "the Service").
Definitions
The definitions of terms used in these Terms are as follows: 1. "Service" refers to the mobile app LIVEorDIE provided by the Company and all related features. 2. "User" refers to any person who agrees to these Terms and uses the Service. 3. "Account" refers to a Google, Apple social login, or anonymous account created by the user for using the Service. 4. "6-Day Survival Challenge" refers to the core game mechanic of the Service where users achieve daily focus goals over 6 days. 5. "Death" refers to a game event that occurs within the Service when a user fails to achieve their daily focus goal by the designated deadline. 6. "Paid Content" refers to items, subscription services, features, etc. that can be purchased through in-app payments. 7. "Milestone" refers to short motivational messages written by users during challenges and shared with other users. 8. "Points (LIX)" refers to virtual currency that can be earned through activities within the Service and used to purchase items.
Posting and Modification of Terms
① The Company shall post the contents of these Terms within the Service or through connected screens so that users can verify them. ② The Company may amend these Terms to the extent that they do not violate applicable laws. ③ When the Terms are changed, the Company shall provide prior notice at least 7 days before the effective date (30 days for changes unfavorable to users) through in-app notices or email. ④ If a user continues to use the Service after the effective date of the changed Terms, they shall be deemed to have agreed to the changed Terms.
Conclusion of Service Agreement
① The service agreement is concluded when the user installs the Service, agrees to these Terms, and creates an account. ② Children under the age of 14 may not use the Service. If a user is confirmed to be under 14, the Company will delete the account and restrict service usage. ③ The Company may reject an application or terminate the service agreement after the fact in the following cases: • When the application was made using another person's information • When false information was provided or the information required by the Company was not provided • When the account was previously suspended or deleted due to violation of these Terms • When the Company determines that service provision is difficult for other reasonable reasons
Provision of Service
① The Company provides the following services: • 6-Day Survival Challenge: Core feature that tracks daily focus goal achievement • Focus Strategy System: Strategy selection among Sprint, Balanced, Deep Focus and timer features • Statistics and Analysis: Data visualization of focus time, survival days, success rate, etc. • Achievements and Titles: Rewards and titles based on goal achievement • Survivor Network: Real-time display of currently focusing users • AI Insights: Focus pattern analysis and motivational messages using Gemini AI (when feature is available) • In-App Store: Purchase of items and premium subscriptions ② The Service is provided 24 hours a day, 365 days a year in principle. However, the Service may be temporarily suspended due to system maintenance, expansion, replacement, or unavoidable technical issues. ③ The Company may change the content, features, and rules of the Service after prior notice, and changes will be posted within the Service.
Focus Challenge System
① The 6-Day Survival Challenge, the core feature of the Service, operates as follows: • Users must complete a daily focus goal (default 90 minutes) according to the selected strategy. • If the daily goal is not achieved within 24 hours of strategy selection, the user is marked as "dead" and the challenge is reset. • Completing goals for 6 consecutive days results in challenge completion. ② The "death" and "revival" mechanics are game elements and do not imply actual death or harm, and are unrelated to the user's health or safety. ③ The Company may change challenge rules, target times, strategy options, etc. after prior notice. ④ Points (LIX) and items within the Service are game elements that assist in achieving focus goals and hold no real monetary value.
In-App Purchases and Subscriptions
(1) Users may purchase items, subscriptions, and other paid content through the in-app store. (2) LIVEorDIE offers the following auto-renewable subscription plans: - LIVEorDIE Pro Monthly: Automatically renews every 1 month - LIVEorDIE Pro Yearly: Automatically renews every 1 year (3) Subscription fees are charged to the user's account upon confirmation of purchase. - iOS: Charged to the iTunes account linked to the user's Apple ID - Android: Charged to the payment method linked to the user's Google Play account (4) Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Upon renewal, the same fee will be charged. (5) Subscription management and auto-renewal can be turned off after purchase: - iOS: Settings > Apple ID > Subscriptions - Android: Google Play Store > Profile > Payments & Subscriptions > Subscriptions (6) If a free trial period is offered, any unused portion of the free trial will be forfeited when the user purchases a subscription to that product. (7) In-app payments are processed through the payment systems of Apple App Store or Google Play Store, and payment method information is managed by the respective store. The Company does not directly collect or store this information. (8) The Company may restrict refunds in the following cases: - When digital content (items, points, etc.) has already been used - When the account has been suspended or deleted due to violation of these Terms (9) Refunds are subject to each platform's refund policy. - iOS: Request through Apple Support - Android: Request through Google Play Support - For other payment-related inquiries, please contact contact@riselix.com.
User-Generated Content
① Users may write short motivational messages through the "Milestone" feature during challenges and share them with other users. ② Users acknowledge and agree that milestone messages they write may be displayed to an unspecified number of other users. ③ Users must not create the following types of content: • Content that defames, insults, expresses hatred toward, or promotes discrimination against others • Violent, obscene, or antisocial content • Content that infringes on others' personal information, copyrights, or other rights • Advertising, spam, or false information • Content that violates applicable laws ④ The Company provides a reporting function for inappropriate content and may delete reported content after review. ⑤ Copyright for content posted by users within the Service belongs to the users. However, users grant the Company a non-exclusive license to use such content for service operation, improvement, and promotional purposes.
User Obligations and Prohibited Activities
① Users must not engage in the following activities while using the Service: • Using another person's account or using the Service through fraudulent means • Interfering with the normal operation of the Service (hacking, crawling, use of automation tools, etc.) • Manipulating focus timer data or achieving goals through fraudulent means • Unauthorized collection, storage, or distribution of others' personal information • Infringing on the Company's intellectual property rights or the rights of others • Unauthorized commercial use of the Service • Other activities that violate applicable laws ② If a user engages in prohibited activities, the Company may restrict service usage or delete the account, and may hold the user legally responsible for any resulting damages.
Service Modification and Suspension
① The Company may change features, content, and policies to continuously improve the Service, and will provide prior notice for significant changes. ② The Company may temporarily suspend all or part of the Service in the following cases: • Technical reasons such as system maintenance, upgrade, or replacement • Force majeure events such as power outages, natural disasters, or national emergencies • When there are significant operational reasons ③ If the Company permanently terminates the Service, it will provide at least 30 days' prior notice. Upon service termination, the Company will separately announce the policy for handling unused paid content (limited to refundable items).
Limitation of Liability
① The Company shall not be liable for service provision in the following cases: • Service interruption due to force majeure events such as natural disasters, war, riots, or terrorism • Service usage disruption caused by the user's own fault • When the user fails to achieve expected results from using the Service (improved focus, academic/work performance, etc.) • Damages caused by disruptions in third-party services (Google, Apple login, etc.) • Accuracy and suitability of content provided by the AI Insights feature ② The Service is a tool to assist with focus enhancement and does not guarantee specific outcomes. ③ The Company is not directly responsible for disputes arising from milestone message exchanges between users.
Account Deletion and Service Withdrawal
① Users may delete their account and terminate the service agreement at any time through the settings menu within the Service. ② Upon account deletion, all user data (focus records, challenge results, acquired items, etc.) will be deleted and cannot be recovered. ③ Paid content purchased through in-app payments will be forfeited upon account deletion, and related refunds follow the store's refund policy.
Intellectual Property Rights
① All copyrights and intellectual property rights for content within the Service (design, logos, UI, text, images, game mechanics, etc.) belong to the Company. ② Users may not reproduce, distribute, modify, or commercially exploit the Service's content without the Company's explicit consent.
Governing Law and Jurisdiction
① The laws of the Republic of Korea shall apply to the interpretation of these Terms and resolution of disputes. ② In the event of a dispute related to service usage, the Company and the user shall endeavor to resolve it through mutual consultation. ③ If a dispute cannot be resolved through consultation, litigation shall be filed with the competent court under the Civil Procedure Act.
